TERMS & CONDITIONS             Updated 23/02/2017

GENERAL:

- In proceeding the client accepts that all terms & conditions have been read and accepted.
- These terms & conditions apply when any work is undertaken whether paid or otherwise, unless agreed in writing by both parties prior to commencement of work.
- A booking is considered firm from the date of confirmation, as agreed in written or spoken correspondence. Accordingly a fee not exceeding 25% of the booking may be charged if postponement / cancellation by the client occurs close to the agreed date. Any expenses incurred due to postponement / cancellation which are not recoverable will be payable.
- Where extra expenses or time are incurred as a result of alterations to the initial brief by the client, or otherwise at their request, the client will be liable for those costs chargeable at the rates previously quoted.
- Invoices are payable within 30 days. Images may not be used commercially before payment unless specifically agreed in written correspondence.
- “Post Production, Digital Archival and Transfer” includes adjustments affecting the entire image, localised tonal and colour adjustments, combining exposures and images together, removal of minor blemishes and distractions, permanent digital file storage and digital transfer at the time of completion.
- “Retouching” includes further works not included above. Where possible this will be quoted prior to commencement.

TERMS OF USE:

- A ‘License to Use’ will be supplied within a cost estimate or separately whenever possible.
- The client agrees to abide by all stated restrictions and limitations of image use supplied with any written correspondence. Any breech of these terms could result in costs to the client equivalent to the industry standard rate for image use in such territories, mediums, sizes and time periods.
- The client is responsible for checking before proceeding that all ‘License To Use’ terms are suitable for the intended use of images provided. If terms are too limiting, different terms must be agreed in writing before proceeding.
- Permission to use photographs outside of the license after production will at the discretion of Alex Bland be granted by agreeing a mutual fee prior to use.
- Any unauthorised use of images by third parties should be reported immediately.
- Title to all photographs remains with Alex Bland always.
- Images should not be manipulated or altered to affect original purpose and integrity, unless written permission is given. Advice will be given when requested.
- The ‘License To Use’ will override these Terms & Conditions in any areas specifically mentioned.
- If no documentation providing written Media use / Period of use / Territory is provided before proceeding with production of photographs due to any reason (including booking with short notice) then the following license to use will apply along with other Terms & Conditions on this page:

{- Images supplied are to be used for the promotion of the services provided by the client.
- Images may be used in print or online for this purpose.
- License is non-transferrable; images cannot be sold or sub-licensed.
- Images may be used for press release and editorial use where Alex Bland is credited.
- Alex Bland retains copyright of all images produced.
- No exclusivity is granted for image use.
- Images may only be used in the country of production.}

LIABILITY:

- Alex Bland is not liable for any costs or incurred to the client or to any third parties through use of images for any reason.
- Alex Bland is not liable for any litigation against the client or third parties through use of images.
- The client is responsible for obtaining any relevant legal permissions and model or building releases when relevant, unless agreed in writing prior to production of images.
